BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

Continuing the investigations of X. Yu and others, we study the role of set existence axioms in classical Lebesgue measure theory. We show that pairwise disjoint countable additivity for open sets of reals is provable in RCA0. We show that several well-known measure-theoretic propositions including the Vitali Covering Theorem are equivalent to WWKL over RCA0.

An important application of cognitive architectures is to provide human performance models that capture psychological mechanisms in a form that can be “programmed” to predict task performance of human–machine system designs. Although many aspects of human performance have been successfully modeled in this approach, accounting for multitalker speech task performance is a novel problem. This article presents a model for performance in a two-talker task that incorporates concepts from psychoacoustics, in particular, masking effects and stream formation.

The standard view of academic freedom and free speech is that they play complementary roles in universities. Academic freedom protects academic discourse, while other public discourse in universities is protected by free speech. Here I challenge this view, broadly, on the grounds that free speech in universities sometimes undermines academic practices. One defense of the standard view, in the face of this worry, says that campus free speech actually furthers the university’s academic aims. Another says that universities have a secondary (...) democratic function, which cannot be fulfilled without free speech on campus. I identify shortcomings in both types of arguments. (shrink)

McGowan argues that everyday verbal bigotry makes a key contribution to the harms of discriminatory inequality, via a mechanism that she calls sneaky norm enactment. Part of her account involves showing that the characteristic of conversational interaction that facilitates sneaky norm enactment is in fact a generic one, which obtains in a wide range of activities, namely, the property of having conventions of appropriateness. I argue that her account will be better-able to show that everyday verbal bigotry is a key (...) factor in social inequality if it tries to isolate a more specific property of conversation as the thing that facilitates sneaky norm enactment. In the interview, Simpson summarizes a particular way of defending the practice of no-platforming. The varying appeal of different defences of the practice in different socio-historical contexts (i.e. the UK/US versus a post-Soviet country such as Estonia) is discussed also.

The last two decades have seen two significant trends emerging within the philosophy of science: the rapid development and focus on the philosophy of the specialised sciences, and a resurgence of Aristotelian metaphysics, much of which is concerned with the possibility of emergence, as well as the ontological status and indispensability of dispositions and powers in science. Despite these recent trends, few Aristotelian metaphysicians have engaged directly with the philosophy of the specialised sciences. Additionally, the relationship between fundamental Aristotelian concepts—such (...) as "hylomorphism", "substance", and "faculties"—and contemporary science has yet to receive a critical and systematic treatment. _Neo-Aristotelian Perspectives on Contemporary Science _aims to fill this gap in the literature by bringing together essays on the relationship between Aristotelianism and science that cut across interdisciplinary boundaries. The chapters in this volume are divided into two main sections covering the philosophy of physics and the philosophy of the life sciences. May lethal autonomous weapons systems—‘killer robots ’—be used in war? The majority of writers argue against their use, and those who have argued in favour have done so on a consequentialist basis. We defend the moral permissibility of killer robots, but on the basis of the non-aggregative structure of right assumed by Just War theory. This is necessary because the most important argument against killer robots, the responsibility trilemma proposed by Rob Sparrow, makes the same assumptions. We show that the (...) crucial moral question is not one of responsibility. Rather, it is whether the technology can satisfy the requirements of fairness in the re-distribution of risk. Not only is this possible in principle, but some killer robots will actually satisfy these requirements. An implication of our argument is that there is a public responsibility to regulate killer robots ’ design and manufacture. (shrink)

The pandemic has been the most vivid agent of change that many of us have known. But it has not changed everything: plenty of the institutions, norms, and practices that sustain racial capitalism, settler colonialism, and cisheteropatriarchy have either weathered the storm of the crisis or been nourished by its effects. And yet enough has changed for us to see that the pandemic has profoundly recontextualised those structures and systems of violence, bringing us into a fresh negotiation with, for example, (...) the question of how we discuss and imagine freedom. Responding in part to this unexpected provocation, activist-scholars Robyn Maynard and Leanne Betasamosake Simpson forged a collaboration from the lockdown of 2020, corresponding by letter to create their forthcoming book, Rehearsals for Living, due to be published by Haymarket Books (US) and Knopf (Canada) in 2022. In this interview, we asked them to explain the epistolary form of the book and expand on the concept of “rehearsal”, before inviting them to reflect on a series of issues that animate our current crises: the politics of recognition; the notion of apocalypse; ways to disrupt linear temporalities; practises of reciprocity against proprietary logics; the gendered violence of state apparatuses; and worldbuilding as a method of resistance. In their expansive answers, Robyn and Leanne draw on their experiences as organisers and educators, commenting on anticolonial struggles, the Movement for Black Lives, and the rise of abolition discourse. Stressing the need to build a multiplicity of shared homespaces in the face of racial/colonial capitalism and organized abandonment, they challenge us to rethink the predicaments and possibilities of the present, enabling us to imagine futures liberated of extractivist, carceral governance – “planting more liberatory futures in the present”, as Robyn puts it. The task of sowing those seeds is a collective praxis of rewriting the narratives that constitute us, refusing to hear that nothing can change and insisting that everything must. (shrink)

The interpretation of complex eigenvalues of linear transformations defined on a real geometric algebra presents problems in that their geometric significance is dependent upon the kind of linear transformation involved, as well as the algebraic lack of universal commutivity of bivectors. The present work shows how the machinery of geometric algebra can be adapted to the study of complex linear operators defined on a unitary space. This paper considers the phenomenon of lying and the implications it has for those subjects who are capable of lying. It is argued that lying is not just intentional untruthfulness, but is intentional untruthfulness plus an insincere invocation of trust. Understood in this way, lying demands of liars a sophistication in relation to themselves, to language, and to those to whom they lie which exceeds the demands on mere truth-tellers.

As humanity becomes increasingly interconnected through globalization, the question of whether community is possible within culturally diverse societies has returned as a principal concern for contemporary thought. Lorenzo Simpson charges that the current discussion is stuck at an impasse-between postmodernism's fragmented notions of cultural difference and humanism's homogeneous versions of community. Simpson proposes an alternative-one that bridges cultural differences without erasing them. ABSTRACT:We combine prior research on ethical decision-making in organizations with a rational choice theory of corporate crime from criminology to develop a model of corporate offending that is tested with a sample of U.S. managers. Despite demands for increased sanctioning of corporate offenders, we find that the threat of legal action does not directly affect the likelihood of misconduct. Managers’ evaluations of the ethics of the act, measured using a multidimensional ethics scale, have a significant effect, as do outcome expectancies (...) that result from being associated with the misconduct but not facing formal sanctions. The threat of formal sanctions appears to operate indirectly, influencing ethical evaluations and outcome expectancies. Obedience to authority also affects illegal intentions, with managers reporting higher prospective offending when they are ordered to engage in misconduct by a supervisor. (shrink)

“Let me tell you where I'm coming from...”—so begins many a discussion in contemporary U.S. culture. Pressed by an almost compulsive desire to situate ourselves within a definite matrix of reference points in both scholarly inquiry and everyday parlance, we seem to reject adamantly the idea of a universal human subject. Yet what does this rhetoric of self-affiliation tell us? What is its history? David Simpson’s _Situatedness_ casts a critical eye on this currently popular form of identification, suggesting that, (...) far from being a simple turn of phrase, it demarcates a whole structure of thinking. Simpson traces the rhetorical syndrome through its truly interdisciplinary genealogy. Discussing its roles within the fields of legal theory, social science, fiction, philosophy, and ethics, he argues that the discourse of situatedness consists of a volatile fusion of modesty and aggressiveness. It oscillates, in other words, between accepting complete causal predetermination and advocating personal agency and responsibility. Simpson’s study neither fully rejects nor endorses the present-day language of self-specification. Rather it calls attention to the limitations and opportunities of situatedness—a notion whose ideological slippage it ultimately sees as allowing late-capitalist liberal democracies to function. Given its wide scope and lively rendering, _Situatedness_ will attract a range of scholars in the humanities and legal studies. It will also interest all those for whom the politics of subjectivity pose real problems of authority, identity, and belief. (shrink)

Counterspeech is communication that tries to counteract potential harm brought about by other speech. Theoretical interest in counterspeech partly derives from a libertarian ideal – as captured in the claim that the solution to bad speech is more speech – and partly from a recognition that well-meaning attempts to counteract harm through speech can easily misfire or backfire. Here we survey recent work on the question of what makes counterspeech effective at remedying or preventing harm, in those cases where it (...) is effective, as well as work investigating when and why there is a duty to engage in counterspeech. We suggest that the most fruitful area for philosophical inquiry on this topic, currently, relates to the questions about efficacy. Specifically, we argue that there is a need for better frameworks for conceptualizing the efficacy of counterspeech. Philosophers have collaborative work to do, alongside social scientists, in developing these frameworks. (shrink)

THOMAS ON THE NATURALISTIC FALLACY Introduction HE PROBLEM OF THE naturalistic fallacy, or the laim that value and ought-judgments are not factual r 'is' judgments, has been a lively one this century, ever since Moore coined the term ' naturalistic fallacy '.1 This debate has died down rather, especially in analytic philosophy, but it has flared up again among students of St. Thomas. This is largely because of (...) the controversial interpretations of Grisez and Finnis.2 In a recent and commendable article Janice Schultz has gone over these interpretations and developed some serious criticisms.3 She rightly points out that for St. Thomas judgments about human goods can be theoretical and not just practical, and that they are practical and have prescriptive or imperative force only on the presupposition of some act of will underlying them. Grisez and Finnis want to say that reason is practical and makes prescriptions of its own nature and not on the presupposition of some prior act of will, and that the grasp by reason of human goods is always practical and never just theoretical. I will not repeat Ms. Schultz's arguments here, though I will use them later on. My reason for wanting to do this is that this debate uncovered a series of important features of good and Ought that must be incorporated into any moral theory, naturalist or non-naturalist, if that theory is to be at all adequate. While modern proponents of naturalistic ethics have tended to play down or ignore these features (largely because they point in a non-naturalistic direction ), St. Thomas did not. His moral theory is superior as a result, and can indeed be said to constitute a model for all defensible naturalistic ethics. This can best be seen if his theory is expounded as a response to the points about good and Ought made by non-naturalists. The first part of this paper is therefore an attempt to state the key theses of non-naturalism; and the succeeding parts attempt to expound St. Thomas's position in response to them. The NaturaUstic Fallacy As Moore first coined the name ' Naturalistic Fallacy ' and initiated the debate about it, one should begin with him. According to Moore, the naturalistic fallacy is a fallacy concerning the idea of goodness. Goodness, he said, is a simple, unanalysable notion, like yellow or red and the fallacy is committed when people try to define or analyse it.4 This is because when they do try to define it they always identify it with some natural or observable property (as pleasure), and good is not such an object. It is a non-natural property that is unique and peculiar to itself. There are two parts to this claim. The first is that good is indefinable, the second is that it is something non-natural. Moore endeavored to establish the first point by means of the so-called open-question argument. Whatever definition one proposes for good it is always possible to ask of the definition whether it is itself good.
